My clients were rearended by a tractor trailer. The massive collision resulted in significant injuries. The defendant blamed other drivers, my client, and a sudden emergency for his failure to follow t ... he FMCSR. Having investigated the wreck, it was clear the cause of the collision was the trucks bad brakes and the drivers failure to properly secure his load. Through the use of an interpreter we took the drivers deposition and forced him to admit to his wrongdoing. Having previously had the trucking company sanctioned for discovery abuse, I filed a Motion for Summary Judgment on all remaining issues of liability against the driver which was granted by the Judge. The case resolved shortly thereafter. The decision from the Judge, granting my Motion for Summary Judgment, is the first reported opinion in a Tennessee state or federal court that finds a violation of the Federal Motor Carrier Safety Regulations to be Negligence Per Se.
