I was able to use the store's own surveillance video against them, showing that they lost sight of my client during the initial visit, and o the trial date, couldn't produce the store agent that was on the floor, thus, no way to prove the initial theft, and subsequently couldn't prove the second theft based upon his proximity to the cashier.
