Represented Med 90, Inc. on appeal of favorable ruling that no oral contract existed with the plaintiff. The Court held the doctrine of the law of the case was inapplicable to a finding of the trial c ... ourt where the appellate court reversed the lower court's judgment, rendering that judgment a nullity.
OUTCOME: Reversed and remanded.
This case ended up throwing most Missouri Divorce Lawyers and, more importantly, their clients, into a huge but understandable panic. It was a Missouri Supreme Court case I briefed and argued involving ... the constitutional role of "Commissioners", as opposed to "Article III Judges" under the Missouri Constitution, within the Family Court system. The Supreme Court ruled that all Divorce Decrees signed by "Commissioners" instead of "Judges" were null and void, in spite of my argument that the "Commissioners" were, in fact, Judges because everyone treated them as Judges. This unfortunate ruling meant that many thousands upon thousands of people throughout Missouri going back umpteen years who thought they were divorced were not, in fact, legally divorced because a "Judge" had not signed their Divorce Decrees. Ouch!
OUTCOME: Adverse trial court ruling reversed.
Appealed the denial of a Motion for Modification based on the Uniform Child Custody Jurisdiction Act, and prevailed before the Western District Court of Appeals in Kansas City to provide our client ano ... ther opportunity to see his children.
OUTCOME: Affirmed.
Appeal from adverse administrative action suspending client's medical license for 24 hours.
