Who is responsible for past unpaid and current HOA dues and fee's with a vacated condo. Listed as a short sale and bankruptcy?

Also, dependent on state law, the HOA may have a right to place a lien on the property for some or all of the HOA fees.

I am finding that I cannot refinance since I did not file a reaffirmation with my mortgage company. Is there a way around this?
