OUTCOME: 120 Days in Rehab
After his fourth DWI, my client was facing serious jail time. The prosecutor wanted my client to spend five years in prison. As a husband and father of three, this had the potential of destroying a f ... amily. My client needed help, both legally and for his addiction. After heavy negotiating with the prosecutor, I was able to convince her to allow my client to spend 120 days in a rehab facility rather spending time in prison.
OUTCOME: Three Class A Felonies Reduced to Two Class F Felonies, No Sex Offender Registry
This client was charged with three Class A Felonies: 1) Statutory Rape; 2) Sodomy; and 3) Molestation. He was accused of having sexual relations with his 11-year-old cousin when he was age 15. The pr ... osecutor wanted my client to register for both the adult sex offender registry and the juvenile sex offender registry. Needless to say, this would have ruined any chances my client would have had of having a normal life. After threatening to take the case to trial, the prosecutor agreed to reduce the charges down to two Class F felonies and with no sex offender registry. My client's record will be expunged at age 18, and he will be able to have the opportunity of fulfilling his dream of becoming a scientist.
OUTCOME: 3 Years Probation
My 27-year-old client was charged with misappropriating funds from the U.S Department of Education after allegedly falsely obtaining a G.E.D. and using it to obtain a Federal Pell Grant. I was able to ... obtain probation for my client despite the District Attorney's original recommendation of at least 6 months in prison. Most importantly, she avoided any jail-time, which allowed her to keep her job and remain at home with her three children.
OUTCOME: $325,000 Settlement
Our client's father died from a failure to diagnose a ruptured appendix. The defendant was a St. Louis area hospital. What could have been a simple operation turned out to be a tragic death. The ori ... ginal attorneys dismissed the case after filing a lawsuit, but then failed to re-file the case within the one-year savings statute. The attorneys didn't notify the client until it was too late to re-file. The difficult with a legal malpractice case like this is that we also had to prove the underlying medial malpractice case. We hired several experts and were able to clearly establish the medical negligence. The legal malpractice was not disputed. After months of negotiating, we were able to mediate the case and settle for $325,000. The money was placed in a structured settlement so that our client will be able to have his college paid for and will be able to receive several payouts throughout his lifetime. The interest earned on the structure settlement will allow him to receive substantially more over the life of the structure.
