N/AOUTCOME: My clients were granted protected time with their grand daughter.
My clients were the maternal grandparents of a five year old granddaughter. Their daughter had separated from her husband and had been living with my clients in New Hampshire for about two years. Their ... daughter suddenly died from cancer. The father, who had very little contact with his daughter, sought custody after the passing of the mother. My clients had been acting in loco parentis in connection with their grandaughter for over a year. They were concerned about the mental/physical safety of their grand daughter in light of her mother's passing coupled with her limited contact with her father. Urtilizing the Grand Parent's Right's statute After a protracted, emotionally charged trial, I was able to secure a court order protecting the custody rights of my clients.
