Mr. Smyth was stopped outside his home on suspicion of DUI. After he entered his residence, the Trooper followed him in moments later. After a confrontation about whether Mr. Smyth was operating his ... vehicle under the influence, a struggle ensued. Mr. Smyth was charged with Aggravated Assault against the Trooper and with disarming the Trooper of his tazer weapon, along with Resisting Arrest. Charges went to Trial at the Lancaster County Court of Common Pleas in the Summer of 2013.
