family violence case where state failed to bring charges to trial within 3 years. I filed a motion requesting dismissal due to a violation of the constitutional right for a speedy trial.
OUTCOME: Not Guilty
Client had a breath test of .17 after being stopped for speeding, the officer said he smelled alcohol on his breath and they did sfsts (field sobriety tests). When I got the video, I noticed many thin ... gs wrong with the sobriety tests, and saw problems with the breath test as well as many other mistakes. At the trial we were able to convince the jury that if there were that many mistakes with the arrest and stop, then could they be sure beyond a reasonable doubt as to the guilt of my client?
