State v. A.R.
Mar 27, 2013OUTCOME: Guilty, but with a 3-month suspension, not the required 7-months.
Middle aged woman charged with her 1st DUI. She rear-ended a car waiting to turn at a red light. The police came and she was told to step out of her car. She was barely able to stand and could not p ... ass any of the 5 roadside tests. The police found 3 bottles of vodka in a bag in the front seat. And she admitted to drinking. She took the Alcotest and the result was .13 - legal intoxication. Anything over .10 would require a 7-month loss of license. Because I able to convince the prosecutor and the judge that the Alcotest machine was unreliable, the reading was not admitted, and my client received only a 3-month suspension.
