I was able to reduce a DUI case for a client who had blood result testing performed that indicated .238 bac. The way I was able to do this was by producing contrary proof of ethanol in his blood with t ... esting performed by a different medical facility. My client had suffered a seizure after being arrested by the police. He was taken to Alton Memorial Hospital where a blood sample was obtained. The test revealed .238 bac. He was flown to a St. Louis area hospital for treatment. When there toxicology revealed no ethanol in his system. He did have a variety of narcotics in his system. We negotiated resolution of the case to a non-moving violation. This was his 2nd DUI.

DUI Statutory Summary Suspension rescinded. My client had been charged with Cannabis based DUI. The current methodology for testing bodily fluids by the Illinois State Police results in merely a positi ... ve or negative presence. In other words, when blood is tested for THC the lab analysis report will state the substance tested positive for the presence of THC. Illinois has created a scientific measurement of THC which raises a presumption of intoxication at a certain level. The ISP lab doesn't conduct its testing to give a result of a certain amount of THC. This is very problematic for the State in prosecution of these cases since they are typically unable to prove the actual nanograms of THC in a blood sample. Anyways I obtained a rescission of the SSS for my client. He will not have a suspension from this event.

Mr. Campbell was charged with this very serious offense when a neighbor claimed to have witnessed him discharge a firearm. We followed up on the statement and the neighbor admitted he actually didn't ... see him with a firearm. I obtained a statement from him correcting his previous statement's error and the case was dismissed.

My client came to me with a notice of forfeiture filed by the State against her residence. She was obviously upset with the fact that the forfeiture was pending as well as her husband being charged wi ... th very serious felony charges. The State believed she knew that her husband was conducted the illegal acts on a home based computer. She was unaware that he had done so. We filed a certified response with what is called an "innocent owner" defense. The State ultimately agreed with us and dropped the case.
