Defendant was pulled over following a report of a burglary and was subsequently arrested for an DUI (OVI). He failed the field sobriety tests, but refused a breathalyzer test.
OUTCOME: The Tenth District Court of Appeals unanimously affirmed the trial court ruling in our favor finding the charge against our client under ORC 2905.05(A) unconstitutional.
