OUTCOME: Consumer won.

A debt-buying company sued my client to try to collect on an old car loan. The collector's witnesses did not know enough about their own evidence. Much of their evidence was not admissible. The coll ... ector was not able to prove they owned my client's account. We won at trial, then the collector filed an appeal. The Court of Appeals agreed with us and ruled that the trial court properly dismissed the collection law suit. The case citation is: John Soliday Financial Group, LLC v. Pittenger, 2010-Ohio-4861 (Fifth District).

Tosheba Andrews v. Felty & Lembright Co., LPA

OUTCOME: Judgment for Plaintiff

Case alleged that Felty & Lembright filed a collection case against Ms. Andrews and attempted to collect more than was due, and more than allowed by law, in violation of the federal Fair Debt Collectio ... n Practices Act and the Ohio Consumer Sales Practices Act. Felty & Lembright offered to allow judgment to be taken against the firm, which Ms. Andrews accepted. Felty & Lembright then paid the judgment. In the prior local collection law suit, Felty & Lembright had obtained a judgment against Ms. Andrews on behalf of their client, Rent-A-Center, Inc. for $3,470.07 plus interest and court costs, but the judgment was later amended to $439.20 plus interest and court costs. The prior case was No. 2009 CVF 03205 in Lima Municipal Court, Lima Ohio.

Stiltner v. Carlisle, McNellie, Rini, Kramerf & Ulrich Co., LPA

OUTCOME: Consumer won

Mr. Siltner alleged that the Defendant, a law firm engaged in collection and foreclosure work, made misrepresentations in a letter sent to Mr. Stiltner, in violation of the federal Fair Debt Collection ... Practices Act. The Court found that the letter misrepresented the identity of the creditor, and failed to properly advise Mr. Stiltner of his right to dispute the alleged debt within 30 days. The Court also noted that the threat of foreclosure in the letter was improper because the letter was not signed by an attorney. The Court granted summary judgment to Mr. Stiltner. According to Carlisle, this was the first FDCPA law suit which the law firm lost.
