The Environmental Review Appeals Commission reviewed the lawfulness and reasonableness of the Ohio EPA Director's issuance of a Permit to Install ("PTI") to the University of Cincinnati for a project a ... t its Central Utility Plant involving the installation of two natural gas and fuel oil fired combined-cycle turbines with duct burners. The central issue was whether the Director's Best Available Control Technology (BACT) determination for the air contaminant sources was lawful and reasonable.
OUTCOME: The case was successfully affirmed by the court of appeals.
Chief's determination that certain operations were exempt from the lands unsuitable for mining petition process was upheld.
