Estate of Charles Clucas
Jan 05, 2016OUTCOME: The court ruled that the brother failed to prove that Charles destroyed the will before he died. We were permitted to probate a copy of the will.
Mr. Clucas had me draw up a will leaving nothing to his brother, who was his closest next of kin. Two years later he died, and the will was nowhere to be found. The disinherited brother claimed that ... Charles had destroyed the will days before dying because he wanted the brother to receive the entire estate. We presented witnesses who gave testimony that contradicted the brother's story.
