After a week-long jury trial, I won a unanimous defense verdict for my client, Morrow County and its Regional Planning Commission. The Plaintiffs purchased over 100 acres of land with the hopes of bu ... ilding a housing development on the property. They never built their subdivision and claimed that the County's planning commission continually rejected their plans for improper reasons. The Plaintiffs eventually sued the County alleging that the planning commission improperly stifled their planned development constituting a "taking" of their property. The jury agreed with our position that the Plaintiffs failed to follow the subdivision procedures and tried to circumvent appropriate rules.
OUTCOME: Judgment affirmed.
I successfully argued this case before the 6th Circuit Court of Appeals in Cincinnati, Ohio preserving judgment in favor of our client, a County Sheriff's Department. The issue was whether a Sheriff's ... deputy's interview and search of an employee of Honda suspected of vandalism on the job was constitutional or whether it was an illegal search and seizure. It was not and the deputy was vindicated.
