Kenn Brotman

Having spent the last 14 years practicing as a litigator, honing my skills both inside and outside the courtroom, I am proficient in steering cases from initiation and discovery through trial. I have a strong rapport with clients and am well versed in researching and analyzing fact patterns, identifying potential causes of action and defenses, and formulating and implementing litigation strategies. I have extensive experience in negotiation and have a track record of successfully negotiating favorable claims settlements for my clients.

What distinguishes me from most law firm litigators is my philosophy. While other litigators view trials as the pinnacle of effective litigation, and measure their worth by the number of trials they have been involved with, I maintain an opposing view. It is as follows: 

● Trials come with a high risk and cost. Therefore, a litigator represents a client most effectively if his or her primary goal is to resolve the case via motion practice, settlement, or alternative dispute resolution, as opposed to maintaining a strict view of preparing a case for trial. 

● Cases should be resolved at the earliest stage and in the most efficient manner possible. While a litigator should always be prepared and willing to take a case to trial if necessary, his or her primary goal should not be to try a case, but to seek to convince the opposing side, the judge or, in some cases, the client, that based upon the facts and/or the law the case does not merit the investment of time and financial resources necessary for a trial. 

● It is only the most unusual of cases that should be tried. Due to the high cost and risk of trials, only those cases impacting the long term goals and strategies of the company should be subjected to those risks.

It is my philosophy and approach to litigation that is the real value that I bring to my clients.
