If you are not in status, and you meet the other requirements, having a visa petition filed for you does not disqualify you.

And you do not need to do anything regarding the H1b. You can only have one status at a time.

If he is in high school, entered before turning 16 and meets all the other requirements, he should qualify.

She can request an expedite, and she may also be able to get a temporary stamp in her passport. I recommend getting an attorney to help.

You can file an I-824. If you are in the U.S., you would not want to process with NVC anyway.

They will probably set bond for him and he can be released. If he has serious convictions, he will not be released.
