You may have a claim against the officer. He needs to have justification for the pat-down search.

Finders keepers is not real law. You should hope the true owner claims it. If not, then after 90 days you will get it. That is fair.

It is possible. More information would be needed. Did he match the description of the suspect in the crime? How long was he held?

If the warrant was valid, then there was probably cause for the arrest. You could at least file a citizen's complaint against the officer.
