Unless you suffered severe permanent injuries it is too expensive to pursue this type of case.

He technically has a claim if he can prove that the delay caused additional injury bu it is unlikely that any private attorney would accept the claim.

You have little real recourse if the statement was made by a 3rd party. The person was a jerk.

Yes as long as you have the object and an x-ray showing it in your throat or stomach. You will need a personal injury attorney.
