Lost Case and Messed Up Credit Report now won't help me!!!

My case was super simple small claim for an accident I was in. Kevin was hired by my insurance. Well actually his company was hired, they originally gave me someone else who got a promotion and a bigger case so they assigned Kevin. That should tell you that his own company has no faith in him that th...ey only give him the smallest cases that they dont' care about. He lost which was not a big deal because my insurance company paid for it, but the biggest issue is that years later when my credit is run to get a car loan I find out that he messed up something so small and I now have a judgement for the amount owed from the case on my credit report. Not only was this paid on time but it wasn't to be paid by me. He simply didn't send in one simple document that he needed to and now my credit is completely messed up. On top of that he told me he does not know how to fix it. the best he could do was get it to say it was paid 4today 4 years later.......that doesn't help my credit report.....Do not hire this guy unless youw ant to lose your case and mess up your credit. he is completely incompetent!

Dear Erin, Your comments about me professionally and personally are misplaced for the most part. You state that someone stopped representing you in this small claims property damage case and I was then assigned. You go on to state "[t]hat should tell you that his own company has no faith in him that they only give him the smallest cases that they don't care about." Erin, my company cares about every case. Moreover, I have handled cases as small as yours and tried cases to verdict where millions of dollars were at stake. You end your comment with "[d]o not hire this guy unless you want to lose your case and mess up your credit. he [sic] is completely incompetent." Your disparaging, slanderous comments are based on emotion and not on fact. Facts: This was a small claims property damage case. Erin was the defendant. The plaintiff was a lawyer himself and had experience in accident reconstruction to boot. Erin's defense was her word. The judge ruled against Erin. There was a judgment entered in favor of the plaintiff for $1,000 plus costs. The company, my employer, paid the judgment. Along with the check, my office sent to the plaintiff a "Release and Satisfaction of Judgment" to sign and return which would have been filed with the court to show the judgment was satisfied. The plaintiff accepted the check but never returned the document and my office did not follow up. I was unaware that the "Satisfaction" had not been returned until Erin called and said the unsatisfied judgment showed up on her credit report. I did not ignore the problem. Motions were drafted and there were at least 2 court appearances. Ultimately, there was an order entered showing when the judgment was originally satisfied. I empathize with your feelings, Erin, about the credit report. My office dropped the ball and you had every right to be miffed. But the remainder of your comments are simpy venemous insults and nothing more. Lastly, AVVO needs to be held accountable for posting comments like Erin's. AVVO's own guidelines state "[b]e helpful, not spiteful. Do not post hostile or insulting content." "Stick to the facts. Reviews that contain unsupported accusations will not be approved." Based on these guidelines, AVVO should not have approved Erin's review.

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
  • Experience & background Years licensed, work experience, education
