Probably can't sue for emotional distress but possibly for conversion, defamation, and fraud.

Report it to your carrier and be sure to report this backstory.
Insurance companies love going after claimants for fraud, as do police....

If your auto coverage included medical payments coverage, that will pay it. If not, you are responsible to get it paid.

Report it to police and to your insurance carrier.
That way, you've complied with the law and your insurance policy.

Not necessarily.
Unless the care you received was not the normal standard of care, surgeries can fail for reasons that are not medical...
