The driver of the moving vehicle is at fault but turn it over to your insurance and let them fight it out.
How can I avoid paying SR-22 insurance because I was mistakenly uninsured during an accident that was not my fault?

You did not cause the accident but you did drive without insurance. That is a separate issue that you now need to fix.

If you were injured consult an attorney. If it is just you had to drive a car that was not as nice for three weeks it is probably not worth pursuing.
