Plaintiff's complaint at law filed under fictitious name without leave of court was not per se null and void, such that amended complaint filed under plaintiff's legal name could not relate back for statute of limitations purposes.
Verdict for Plaintiff sustained on Defendant's appeal alleging improper pre-trial disclosure.
Jury verdict for Plaintiff reinstated reversing the trial court's Judgment NOV.
Trial Court remitted $12,300,000 jury verdict by $5,000,000 to which the plaintiff agreed. Defendant appealed seeking to reduce plaintiff's award further. Plaintiff cross-appealed and the original $12,300,00 verdict was reinstated.
