Plaintiff is the creator of a highly complex and confidential proprietary trading model that implements select market strategies and executes trades on a high frequency basis. Plaintiffs involvement ... with Defendant began in 2005 during a phone call and grew to a partnership fostered during 2006. The partnership was founded in order to utilized the prop trading model under the terms that Plaintiff and Defendant would split any profits, that Plaintiff would be 'controller'/trading model programmer/inventor, and that Defendants role would be to bring in a steady stream of clients. While both Plaintiff and Defendant did in fact play those roles within the framework of the partnership, Defendant - outwardly to clients - denied Plaintiffs involvement in any facet of the creation or implementation of the trading model. Moreover, Defendant fraudulently and intentionally withheld client funds and partnership profits due and owing to Plaintiff. In an attempt to further alienate the Plaintiff from the trading community, the Defendant made multiple defamatory and false remarks in regard to Plaintiff as a ploy in order to push Plaintiff out of the partnership and retain rights to the trading model. As a result of the above stated actions, Plaintiff sustained significant and life-altering damage to his professional and personal lives. But for the actions of the Defendant, witnesses testified during trial that today’s valuation of the partnerships business portfolio would exceed a quarter billion dollars.
