OUTCOME: Habeas corpus granted - client ordered released
Federal habeas corpus petition and hearing in homicide case; Petition granted, and Mr. H released. I identified an alternate suspect, guilty of a string of similar crimes in the same area, and produced ... evidence of shortcomings in the litigation of the initial trial. This convinced the Court to order Mr. H's immediate release.
OUTCOME: Exonneration
I represented Mr. W to attempt to free him from a one-hundred year sentence after he had been wrongfully convicted as a serial rapist and his appeals had been exhausted. In proceedings before the Presi ... ding Judge of the Criminal Court in Chicago I presented evidence of government misconduct and DNA results proving another man, in prison for similar crimes, was the actual perpetrator. The Court ordered his release, and after 9 years imprisonment I drove Mr. Willis home from Stateville Prison. I represented him before the Illinois Prisoner Review Board; he was pardoned by the Governor for actual innocence and granted compensation by the State. The case was featured on Dateline NBC, A & E’s Investigative Reports, and TLC’s Secrets of Forensic Science, and described in the book, "Actual Innocence," by Barry Scheck and Peter Neufeld of the Innocence Project. Mr. W then sued government entities for misconduct and obtained a settlement of $2.5 million.
