The driver decided to try to pass a line of three tractor trai ... lers. In front of the lead tractor trailer was a tank truck which was making a right hand turn into a residence. The lead truck turned into the lane for oncoming traffic to get around the turning tank truck just as the vehicle in which our client was a passenger was closing on the lead tractor trailer at a high rate of speed as part of the passing maneuver. The client's driver turned the wheel to the left to avoid going under the trailer and went off the road. It hit a culvert and flipped end over end, with the client suffering a fractured wrist and compression fractures in the cervical and thoracic spine. There was no contact between the tractor trailer and the vehicle in which our client was riding. We were able to secure admissions from the driver of the lead tractor trailer that he failed to leave adequate stopping distance between him and the tank truck and that he turned into the lane for oncoming traffic knowing that the car was approaching from behind at a high rate of speed, and this ultimately resulted in being able to settle the case.
