A Trail Court improperly awarded custody of a 16 year old child to his Father who resided in Virginia. Prior to that, the child had lived his entire life with his Mother in Montgomery County and spent ... approximately one weekend per month with Father in Virginia. The relationship between Father and child was extremely strained. It was my belied that the Trial Judge changed custody to punish Mother as the Judge did not feel Mother was encouraging the child enough to spend time with Father. I appealed the case to the Superior Court. After oral argument, the Superior Court agreed that the Trial Judge abused her discretion and reversed the decision so that the child remained in Mother's custody.
