Blume Goldfaden Partner, Norberto A. Garcia, represented and went to trial in a case for a 39 year old woman who went shopping the day after a snow storm at a strip mall in Union City, New Jersey. The ... snow was still being cleared from the mall's parking lot by the mall owner's subcontractor, and our client was directed by mall owner/management to park in an area which they represented had already been cleared of the snow and ice hazard. In fact, this area was unsafe in that the snow had been cleared, but no salt had been spread for ice removal. After exiting her car, our client slipped and fell on ice, severely fracturing the tibia and fibula of her lower left leg, and penetrating the skin; requiring surgery. The woman went on to develop sequestrum, a bone abnormality condition causing fluid drainage from the site of the wound, which continues. There was no offer to settle the case before trial. The jury found both the mall owners and their subcontractor liable, and awarded $700,000. for pain and suffering, and $129,000. for medical bills.
