OUTCOME:

Defendant (represented by Amentas) successfully obtained an order vacating a judgment by default entered again his client and ultimately obtained a judgment in the Defendant's favor at trial. Plaintif ... f appealed, arguing that the trial court judge should never have vacated the judgment. The Appellate Division division sided with Defendant on appeal, upholding both the trial court's decision to vacate the default as well as the result at trial. See citation at 2017 WL 4228071.

Matter involved an employee retirement plan governed by the Employee Retirement Income Security Act of 1974 (“ERISA”). Defendants including Out of Site Infrastructure Retirement Plan (represented by Am ... entas) moved for judgment on the pleadings seeking, among other things, to preclude Plaintiff from pursuing claims on behalf of Plan members other than the Plaintiff. The Court sided with Defendants, thereby considerably limiting the Defendants' exposure. See citation at 2017 WL 3394735.

Insurer commenced actions in diversity seeking declaratory judgment either that life insurance policies were void or that beneficiary was not entitled to benefits. Beneficiaries including the Estate of ... Paul Godlewski (represented by Amentas) filed counterclaims for bad faith. Insurer moved for summary judgment. Court sided with Beneficiaries, determining that issues of fact existed which were matters left to the jury. See citation at 221 F.Supp.3d 617.
