During those Hearings he was able to lock the Off ... icer into testimony stating that he did not conduct the SFST’s in the proper standardized manner. As such, at trial, the Commonwealth choose not to put forth any testimony with regard to SFST’s. Therefore, the only evidence of impairment that was offered was an Odor of an Alcoholic Beverage and what appeared to be slurred speech. However, Attorney Barrouk was able to lock the Officer in that these factors are not necessarily indicative of impairment. Upon the close of the Commonwealth’s case Attorney Barrouk made a motion for judgment of acquittal to the Honorable Thomas H. Kelley IV. Judge Kelley agreed with his contention that even when viewed in the light most favorable to the Commonwealth, the Commonwealth failed to meet its burden of proof. Therefore, he dismissed the case without Attorney Barouk having to present a defense and without the Jury having to deliberate.
