In this case we challenged the North Dakota medical assistance statute as being unconstitutional since it placed a limitation on the amount of income that a spouse living at home could have when the ot ... her spouse was living in a nursing home and was receiving Medicaid. The federal district court ruled in our favor and the North Dakota Department of Human Services appealed to the 8th Circuit Court of Appeals.
