Photographer Ed Marco sued magazine publisher for republishing photos that had been licensed for one-time use. Although the district court, per Judge Herbert Hutton, found to the contrary, the Third C ... ircuit Court of Appeals determined that Marco, as an independent contractor, owned the copyright to his photos.

OUTCOME: Dismissed on summary judgment.

Seven Up distributed a promotional poster before Christmas, having an Advent Calendar forming a picture of Santa Claus' beard. Plaintiffs claimed that the poster infringed the copyright for their Sant ... a Advent Calendar. The case was dismissed on summary judgment, and plaintiff's appeal was dismissed as untimely.
