OUTCOME: Reversal and remand in favor of Husband/Father

Husband and Wife acquired law degrees, married, and had 3 minor children. Husband and Wife were married for 17 years. Husband developed his career earning a 6 figure yearly income. Wife eventually stop ... ped working and became a homemaker. At trial, Wife's income was minimal and had done little to rehabilitate herself back into the workforce. Husband retained a vocational expert who testified Wife could earn ranges of income as an attorney, paralegal, or loan officer. Trial court computed spousal and child support amounts entering zero income for Wife and awarding increased spousal/child support amounts against Husband. Husband appealed to the Ohio Ninth District Court obtaining a reversal and remand. Issues dealt with family law, evidence and computing spousal and child support amounts; preparation and use of a vocational expert and evaluation at rial. Appeal dealt with the use and application of 3 different "standards of appellate review"-sufficiency of evidence; weight of the evidence; and abuse of discretion.
