Jun 06, 2013OUTCOME: Probation instead of jail. A petition to expunge the felony charges is in the process of filing with the court.
In 2012 I was contacted by a Penn State student as a result of his arrest for violation of the drug act. This included 2 counts of possession with intent to deliver a controlled substance, (felonies), ... 2 counts of possession of paraphernalia, and 2 counts of simple possession of a controlled substance. These charges resulted from direct sales of marijuana to a confidential informant and the resulting search of the residence. The young man was looking at a potential long period of time in jail. After a long period of negotiation, I was able to achieve a plea agreement with the prosecution to 2 counts of "receiving in commerce" (a minor misdemeanor) and probation. He is back in school at State College, doing well and does not have a drug felony in his past.
