INEFFECTIVE FOR A PUBLIC HOUSING EVICTION

Solomon was appointed by the court to represent me in an (unlawful and illegal) eviction. It was HUD Section 8 housing so under Minn. Stat. 504B.268 he was supposed to have at least 2 years of experience in public housing evictions or else be supervised by someone that did. This admitted this was his... first eviction case, ever. And I had questioned him if he met the statutory requirement because I knew that it was an illegal eviction but he was convinced that it was a "cut-and-dry case"...I said well, you're wrong and since you don't meet the statutory requirements, I have to inform the court and apply for a new court-appointed attorney who does meet the statutory requirements. I left his office and drove straight to the courthouse. When I got there, Solomon had emailed the court saying that I just fired him for no reason and pleaded for reimbursement claiming he worked so hard for me. The judge yelled at me in court saying I wasn't allowed to fire a court-appointed attorney...my replacement court-appointed attorney who ALSO failed to meet the criteria (1 prior eviction-not public housing) whispered, "that's not true, the judge is lying about that." The judge of course was unfair and ruled in favor of the landlord but I appealed pro se and the appellate court reversed and dismissed the district courts erroneous ruling! Never trust a court-appointed attorney! And his "hard work" was just an email from the landlord's attorney that said the exact same phrase, "it's a cut-and-dry case". I don't know who's worse, the court for appointing counsel that didn't meet the statutory requirement, or the attorney who accepted the court's appointment knowing that he wasn't qualified... Actually, both, because there's nothing that suggests either of them were practicing law or following the law.

Avvo Rating

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
  • Experience & background Years licensed, work experience, education
  • Legal community recognition Peer endorsements, associations, awards
  • Legal thought leadership Publications, speaking engagements
  • Discipline Disciplinary information may not be comprehensive, or updated. We recommend that you always check a lawyer's disciplinary status with their respective state bar association before hiring them.
