Aug 22, 2013OUTCOME: After two rounds of mediation and significant post-mediation discussions, the Library Board ultimately considered and approved a total settlement of $580,000, which was used to defray the costs of repair.
The Library Board came to me after experiencing ongoing, but non-life-threatening, problems with their fire suppression system. Investigation determined that thinner pipe was substituted for thicker p ... ipe and some pipes were not appropriately pitched for drainage. In the course of exploring and repairing those problems, additional design and construction problems were discovered. We worked with the Library Board through extensive efforts to resolve the case without litigation, but were ultimately forced to file suit. After written discovery and a number of depositions, the parties were able to mediate to a settlement. That settlement was submitted to and approved by the Library Board and entered into the public record.
