The questions of the plaintiff's back injury was disputed in this car acident claim. The defendant believed that her low back injury pre-existed the accident, while the Plaintiff contended she injured ... her back as a result of the accident. The case went to a Greene County jury, who awarded the plaintiff $150,000.00. My client was on her way to a hair appointment when she stopped to allow pedestrians to cross the roadway. The Defendant drove his BMW into the rear of her car while she was lawfully stopped. The Plaintiff reported the back injury at the scene and was taken by ambulance to the local hospital. While there was only $737 in property damage to the Plaintiff's vehicle, and no damage to the defendant's BMW, she incurred well over $20,000 in medical bills. Most of these bills involved treatment for the low back injury sustained in the accident. She also attributed a subsequent knee injury to the weakened condition of her back because the weak back caused her to fall.
