In this custody dispute over eight-year-old child., the District Court’s custody order granted sole legal and physical custody to our clients, the child's paternal grandparents and parenting time to M ... other. Mother argued on appeal that clear and convincing evidence did not support the District Court’s finding that the reasons for placing the child in her Grandparents' primary care override the child’s interest in a day-to-day relationship with her mother. She also argued that the District Court should have treated the Grandparents' petition as a motion to modify custody, should have given greater weight to particular facts, and should have assigned Mother at least 25% parenting time. Because the evidence supported the District Court’s finding that the child faced physical and emotional danger in her mother’s care and because Mother’s other arguments do not support reversal, the Court of Appeals affirmed the District Court's Order.
