Hawkins v. State
Dec 15, 2012OUTCOME: affirmed
One of the few cases in the nation challenging the search of a cell phone. With developing technology, the argument before the Georgia Supreme Court was whether the officers who searched Hawkins' cell ... phone were required to obtain a warrant. The Georgia Court held a cell phone is similar to a container and can be searched incident to arrest. The U.S. Supreme Court has agreed to take on the same issue from other state cases and the outcome should be interesting.
