John Tanquist Soshnik

John is a partner in Lindquist & Vennum’s Health Law practice group, representing healthcare professionals and businesses on a broad range of transactional and regulatory matters.   John’s clients include healthcare providers (hospitals, physician group practices, integrated delivery systems and other healthcare professionals and licensed entities), managed care organizations, third party administrators, health and wellness service providers, medical device companies, software vendors and technology companies.  John has experience regarding healthcare fraud and abuse and related regulatory and compliance issues; healthcare technology (including electronic health records, personal health records, telemedicine and video-health products); health information and financial data privacy and security (including HIPAA, Gramm-Leach-Bliley, and other state and federal privacy law); wellness and disease management products and programs; and the integration of healthcare benefits, technology and financial solutions (including consumer driven healthcare products such as health savings accounts (HSAs), coordinated investment products and credit products).

John understands his healthcare clients’ business needs and challenges, having been not only a lawyer in private practice but also in-house counsel at UnitedHealth Group and a regulator with the Minnesota Department of Health.

Representative Experience

• Advised a national managed care company in its co-branded product development and marketing agreement with a non-profit PHO serving Eastern Pennsylvania
  
• Represented a hospital system in the acquisition of a 90-physician multi-specialty group
  
• Assisted an international LASIK provider establish facilities throughout the United States
  
• Advised healthcare providers and vendors regarding telehealth and video-health technology service arrangements
  
• Negotiated a hospital’s purchase of a primary care physician group practice
  
• Represented hospitals and provider groups in contract negotiations with electronic health record (EHR) vendors and compliance with “meaningful use” requirements
  
• Advised covered entities and business associates on the amendment of HIPAA business associate agreements; drafted and negotiated amendments and related tools
  
• Advised a Midwestern hospital system in the settlement of a qui tam action involving allegations of violation of the Stark law
  
• Represented a national bank in its acquisition of an HSA portfolio
  
• Advised a national managed care organization in the expansion of its national provider network
  
• Counseled healthcare companies hosting personal health records (PHRs) with respect to technology and licensing issues, FTC breach notification requirements under ARRA, applicability of HIPAA privacy and security law and state health and financial information privacy laws
