Client had underage friends of his daughter over to the house, the police were called due to one of them being a runaway, and some of them made allegations of inappropriate conduct by my client. I tho ... roughly investigated the facts of the case, filed a Motion to Quash the Indictment, and, after a hearing, the judge granted my motion which required the DA to revise the indictment and make a much more favorable plea offer to my client. The offer was initially 8 years imprisonment but was reduced to deferred adjudication probation which my client accepted.

OUTCOME: Client accepted a very reduced plea offer of time served on a misdemeanor (initially 8 years in prison)

Client was at a party with a girlfriend and several other individuals. Client and girlfriend had consensual sex. The other individuals told client to leave and he refused saying that he had permissio ... n to be there. Girlfriend decides to ingratiate with the other individuals and calls the police alleging client raped her. Police arrest client and charge him. I filed a Motion for Speedy Trial and conducted an in-depth factual investigation which showed that girlfriend was a serial complainant to the police often making false or questionable allegations and in car video footage appeared to indicate that she was also fabricating this allegation. After seeing all the evidence the DA allowed client to plead to a misdemeanor for time served.

OUTCOME: District Attorney dismissed the case.

Client and his girlfriend were drinking and got in a verbal disagreement. She told him to leave. He agreed to do so and began packing his belongings. She then changed her mind and wanted him to stay ... . He refused. She began unpacking his bag. When she reached into his backpack to unpack it he lunged at her and pushed her away and held her back because he had a loaded firearm in the backpack and he didn't want it to discharge. After talking to her husband about it the next day she called the cops and they took a statement. She claimed that client choked her but no evidence supported this claim.
