Ellis v. C.R. Bard, Inc. et al.
Nov 12, 2002OUTCOME: Appeal was favorable for my client, as I represented a defendant in that case prior to starting my own law firm, Bass Law, LLC.
Ellis sued morphine pump manufacturers claiming they were liable for her mother's brain damage caused after Ellis' sister operated a morphine pump prescribed for her mother while her mother was sleepi ... ng, thereby over-administering morphine to her mother. She claimed they were liable because of defective labeling and specifically, failure to warn adequately of the danger of having a person other than a doctor or patient activate the pump. The district court granted summary judgment in favor of the defendant manufacturers, and Ellis appealed. After oral arguments and on appeal, the Eleventh Circuit affirmed the district court orders.
