We represented the Trustee of a publicly-held company that filed for bankruptcy. The Trustee brought claims against the officers and directors for breach of fiduciary duty. The court denied the Motion ... to Dismiss filed by one of the officers. The court's decision in April of 2008 was a rare decision that directly applied the Caremark duties of oversight to a corporate officer, as opposed to a director.
