The Defendant was arrested for DUI and after giving a breath test requested an additional blood test. He could not however pay for an additional test because the arresting officer had seized his wallet ... with his money. He was denied his additional test. The trial Court granted our motion to suppress the breath test result on the ground the blood test had been denied. The State appealed the decision as prosecution was impossible without the breath test result.
