The court agreed and granted summary judgment in Defendant's favor, dissolving the injunction without the need for trial.

Studio Z Homes listed its 43 properties for sale through Urban Living, a real estate brokerage owned by Vinod Ramani. Urban Living promised to do very specific things to try to sell the properties, in ... cluding placing advertisements in certain newspapers and magazines. Urban Living did not comply with the agreements, but refused to relinquish control of the property listings. Studio Z Homes learned that Urban Living and Mr. Ramani were telling its agents to steer homebuyers to other properties on which Urban Living would make a higher commission.

Plaintiff was real estate developer who was building nine townhomes worth $2.7 million. It contracted with Defendant for Defendant to design and supply all finish materials for interior of homes. Def ... endant caused delays in finishing homes, but blamed delays on Plaintiff. Defendant filed liens on all nine properties, preventing them from being sold. Plaintiff and Defendant sued each other for breach of contract. The jury found that Defendant breached the contract and that the liens filed by Defendant were invalid.

Defendant's husband was a trustee of the trust. He invested trust funds under his and Defendant's name. When he died, Defendant refused to return investment to trust, and she moved money from institu ... tion to institution to avoid its return to Plaintiff. A jury found that Defendant committed conversion and fraud, and the court imposed a constructive trust on the funds held at the financial institution, regardless of in whose name the funds were held. Plaintiff then froze the funds out-of-state to ensure the judgment could be collected.
