My client had Divorced his wife many years earlier. At the time of the divorce the parties signed a settlement agreement giving him primary custody of a child that his wife had given birth to prior to ... the marriage. There was always a question as to whether or not he was the biological father. Despite this question, my client had raised and nurtured the child and had been his primary caregiver ever since the divorce. Then, the mother filed a modification of custody action, stating that my client was not entitled to custody because it was not his child.
