I represented a father whose child was removed from his home pursuant to an Emergency Removal Order on an allegation of child abuse and neglect from Loudoun County CPS. The ERO contained an affidavit s ... etting forth CPS's reasons for placing the child in foster case that did not comport with Virginia Code Section 16.1-251. Two other attorneys decided to concede the Preliminary Removal Order, but my client, upon receiving legal advice, opted to contest it and have the full adjudicatory hearing at the five day mark.
