He has significant experience initiating and defending a variety of cases through trial and appeal in substantive areas of law such as: copyright infringement, shareholder disputes, breach of contract disputes, Indian gaming disputes, commercial torts, defamation, interstate shipping disputes, product liability, professional liability, trademark infringement, consumer warranties, consumer fraud claims, and Articles 2, 2A, 3, 5, 8, and 9 of the Uniform Commercial Code.
Apart from his commercial litigation practice, Mr. Barton has experience in constitutional litigation, having represented one of the Unnamed Movants in the State of Wisconsin’s John Doe II Investigation, which was declared unconstitutional by the Supreme Court of Wisconsin and resulted in significant amendments to the State’s John Doe Statute.
Outside of litigation, Mr. Barton has experience drafting comprehensive warranties subject to both Article 2 of the Uniform Commercial Code as well as the Magnuson-Moss Warranty Act. He also has experience counseling clients on a variety of regulatory matters including compliance with the Consumer Product Safety Improvement Act, food labeling requirements subject to the Food, Drug, and Cosmetic Act, and the distribution of alcohol at the state and federal level.
