The Judge decideds any and and all motions. A motion to dismiss is up to the court . Speak with your lawyer.
Speak with your attorney to see if you have a basis for a request for recusal. That’s an uphill battle and you will never get all 4 to recuse.

The court will file it electronically and send copies to all parties. The court can’t simply toss it or file it or even ignore it.
