Winker vs. Winkler, 282 Wis. 2d 746, 2005 App 100, 699 N.W. 2d 652 (April 26, 2005)
N/AOUTCOME: The BacDrop payment was not considered as marital property to be divided equally since the benefit was paid after the divorce was final. However, it was considered to be income for payment of child support.
Husband received a BacDrop Payment from his Milwaukee County Pension. Wife was to receive one half of the monthly payments since it could not be divided by a Qualified Domestic Relations Order. A Bac ... Drop allows an employee to receive a large lump sum payout while reducing the monthly benefits if he or she continues to work and contribute towards a pension. Husband also did not consider the BacDrop to be income for purposes of payment of child support.
